Customer Agreement By submitting this form, Customer agrees to abide by the terms and conditions outlined below. Terms and Conditions Summary: 1) Orders are not processed live and if an order is made after hours, it will be processed the following business day. 2) If a travel fee is required for your location, your approval will be sought for the amount before we process your order. 3) For next day orders, availability will be confirmed before the order is processed. If we cannot service your move you will not be charged. 4) For SAME DAY orders a $150.00 deposit is required. If we successfully schedule your move and then a cancellation is placed your deposit will not be refunded. This policy specifically applies to same day orders. If we are unable to schedule your move your deposit will be refunded. 5) After an order is confirmed and processed, a confirmation email will be sent to the email address provided confirming the rate details, deposit payment and summarizing your order. If you do not receive a confirmation email within 2 business days please contact our toll free line. Remember to check your spam box as well. Section 1. Use. Use of ELITEMOVINGLABOR.COM is provided solely for current and potential customers and may not be used, reproduced, duplicated, copied or sold by any other person or entity, or for any other purpose. Section 2. Ownership. The content of ELITEMOVINGLABOR.COM is protected by United States and international copyright, trademark and other laws. Section 3. Indemnity. You hereby release, and agree to defend, indemnify and hold harmless ELITE MOVING LABOR LLC, its parent, and affiliated companies, along with their respective officers, directors, employees and agents from any and all claims, demands, causes of actions, liabilities, damages, costs and expenses, including reasonable attorneys' fees, arising out of your use or viewing of ELITEMOVINGLABOR.COM and its Content. Section 4. Disputes and release/waiver of liability: Because we are a neutral venue, we are not responsible for resolving any disputes between you and the service provider regarding the services. All disputes must be resolved between you and the service provider. Furthermore, the transaction and any resulting provision of services are solely between you and the service provider. Therefore, when and where there are any claims, demands, liabilities, damages or losses incurred as a result of such transaction and/or provision of services, you, your heirs, successors and assigns, do hereby waive and release Elite Moving Labor LLC (our officers, directors, agents, parent, subsidiaries, affiliated companies and employees) from any such claims, demands, liabilities, damages or losses. Section 5. Transaction for Services: By clicking "Submit", you acknowledge and agree that you have submitted an order request and that this is your effective offer to enter into a transaction for the services with your assigned service provider and agree that you are legally fit to enter into such an agreement. Section 6.1. Rush Orders and Travel Fees A placement of order does not guarantee service for your specified date or time. Last minute and rush orders will first have their availability determined before processing the order. Customers requesting immediate service through our online order form will be contacted by telephone prior to order processing. If a travel fee is required for your service area, the submitted order will not be processed without directly communicating the amount of the fee with the customer prior to proceeding with the order. Section 7. Payment for Services: By ordering moving labor services you acknowledge and agree that you have authorized payments for the deposit amounts of the services and that you have authorized us to charge the deposit amounts against your credit or debit card and that you will make the remaining payment to your assigned service provider in order to complete the transaction for any provided services. Section 8. Cancellation Policy: NOTE: The cancellation policy for same day moves differs from standard cancellations and is outlines in section 8.1 A $50 cancellation fee per order is required for all orders that are booked and confirmed, regardless of when the order is canceled. Cancellation requests must be received prior to the service providers arrival at your requested location to avoid additional charges outlined in 8.2, "No Show Fee". The difference between your deposit and the cancellation fee will be refunded by check within 7-10 business days. Section 8.1 Cancellation Fee for Same Day Orders If you placed an order and require service for the same day we will do everything possible to accommodate your request. We require a $150.00 deposit at the time of booking, if we are unsuccessful in scheduling a crew your deposit will be refunded. However, if a crew is confirmed and then a cancellation is made no refund will be provided. Section 8.2 No Show Fee In the event that your order is placed and confirmed but you fail to show up at the specified location or you cancel after the crew has departed, you authorize Elite Moving Labor LLC to charge your card on file a $150.00 No Show Fee in addition to the $50.00 cancellation fee outlined in section 8. Section 8.2. Reschedule Policy In the event that you need to reschedule your move date or time, arrangements will be made without a few providing that the customer notifies Elite Moving Labor LLC within 24 hours of the reserved date and time and we have availability for the newly requested date and time. If the customer reschedules the move date within two hours or less of their reserved move date/time, they will be responsible for the No Show Fee. Section 9. Confidential Information. Your access to and/or use of the Website and content, and your performance of this Agreement will result in our disclosing to you or your learning of certain data and/or information that is proprietary and confidential that is our Confidential Information. For purposes of this Agreement, “Confidential Information” shall include but not be limited to any and all non-public information disclosed to or learned by you concerning our business and/or operations, computer hardware and software and other information technology; specifications, processes, procedures and manuals; marketing/business/financial data, information and plans; and information and/or data regarding Suppliers and Service. Section 10. Use of Confidential Information. Confidential Information shall be used solely for the purpose of viewing, reserving and purchasing Service and in performance of this Agreement. You shall treat Confidential Information that you receive or learn of with the same level of care against unauthorized disclosure as you treat like information of your own, and in all events at least with reasonable care against unauthorized disclosure.
